Representative Eric Swalwell faces a 2 PM deadline today to resign from Congress or face formal expulsion proceedings, as Representative Anna Paulina Luna follows through on her threat against the embattled California Democrat now facing multiple sexual misconduct allegations.
Luna’s Ultimatum Draws Hard Line
Representative Anna Paulina Luna of Florida announced on social media that she will move forward with her expulsion resolution if Swalwell fails to submit his resignation to the Clerk of the House by 2 PM today. Luna called Swalwell’s Monday statement about planning to resign not binding and wormy, rejecting his effort to delay the process. She indicated similar action awaits Representative Tony Gonzales of Texas if he does not resign. Luna stated she believes Swalwell faces serious criminal problems and may end up in jail.
Swalwell ended his California gubernatorial campaign Monday and announced plans to resign his House seat representing California’s 14th Congressional District. He claimed the delay would allow his staff time to serve constituents’ needs and argued that efforts to remove him without due process are wrong. The Manhattan District Attorney’s Office is investigating a sexual assault allegation against him. Multiple rape and sexual misconduct allegations have shredded his career and public image.
I'm glad Eric Swalwell is finally on his way out of Congress.
He should take the rest of the creeps with him. Washington is infested with them.
The American people are fed up with this depraved, disgusting behavior from our so-called leaders. It's time to restore basic decency,… pic.twitter.com/z8VpjP8H74

Rare Congressional Action Looms
An expulsion would place Swalwell among only six House members ever expelled from Congress. The most recent expulsion occurred in 2023 when former Representative George Santos of New York was removed after facing federal indictments on numerous charges. The rarity of this congressional punishment underscores the severity of the situation facing Swalwell, who appears likely to avoid the historical stain by resigning before the deadline.
Political Implications for House Balance
Swalwell’s departure from Congress will expand the Republican majority to four seats, shifting the balance to 217 Republicans and 213 Democrats. This increased margin provides Republicans additional flexibility in advancing their legislative agenda. The deadline Luna imposed demonstrates the determination of some House members to swiftly address allegations of serious misconduct rather than allow prolonged processes that could extend for months. Whether Swalwell meets the 2 PM deadline or faces formal expulsion proceedings will determine how this chapter of congressional history closes.
